Aurevyn – Terms of Service

Welcome to Aurevyn ("App," "Service," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Aurevyn mobile application and related services. Please read these Terms carefully before using the App.

1. Acceptance of Terms

By downloading, installing, accessing, or using Aurevyn, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available within the App and at our website). If you do not agree, you must not use the Service.

By clicking "Sign Up," "Create Account," or any similar registration button, you provide affirmative consent to these Terms.

2. Eligibility

You must be at least thirteen (13) years of age to use Aurevyn. If you are between 13 and 18 years old, you must review these Terms together with a parent or legal guardian, and your parent or guardian must consent to these Terms on your behalf. We do not knowingly collect information from children under 13. Please refer to our Privacy Policy for additional details regarding children's privacy.

5. Intellectual Property

5.1 App Content and Branding

All content, design, graphics, trademarks, logos, and software comprising Aurevyn are owned by or licensed to us and are protected by United States and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any portion of the App without our prior written consent.

5.2 Scripture Texts

Bible texts displayed within the App are used under license from their respective copyright holders or are sourced from public-domain translations. Specific version attributions are provided within the App where applicable. You agree to respect all applicable copyright notices and usage restrictions for Scripture content.

5.3 User-Generated Content

You retain ownership of any content you create within the App (such as prayer tags, custom labels, or personal notes). However, by submitting or storing such content through the Service, you grant us a non-exclusive, royalty-free, worldwide license to use, store, reproduce, and display that content solely for the purpose of providing and improving the Service.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AUREVYN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ZERO DOLLARS ($0.00) IF YOU HAVE NOT MADE ANY PAYMENTS.

8. Dispute Resolution and Arbitration

8.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to contact us at support@aurevyn.com and attempt to resolve the dispute informally within thirty (30) days.

8.2 Mandatory Individual Arbitration

If the dispute is not resolved informally, you and Aurevyn agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in the State of Delaware or, at your election, via telephone or video conference.

8.3 Class Action Waiver

YOU AND AUREVYN AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.

8.4 Exceptions

Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

9. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update these Terms from time to time. When we make material changes, we will notify you through an in-App notification or via the email address associated with your account. Your continued use of the Service after such notification constitutes acceptance of the revised Terms.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination (including, without limitation, intellectual property, disclaimers, limitation of liability, and arbitration) shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aurevyn regarding the Service and supersede all prior agreements and understandings.
